General conditions of saleyou

1: Object
These conditions of sale define the contractual relations between Vanill'Art and the customer as well as the conditions applicable to any purchase made on the site, whether the customer is a professional or an individual.
The act of purchase implies the unreserved acceptance by the customer of these conditions of sale.
These conditions of sale shall prevail over any other general or specific conditions not expressly agreed to by Vanill'Art.
Vanill'Art reserves the right to modify the terms and conditions of sale at any time. The applicable conditions are those in effect on the customer's date of purchase.

2: Vanilla Order
Customers can contact Vanill'Art by email or phone to place an order or for any information. Payments by bank transfer are accepted.
Orders are processed in the order they are received and subject to availability. In the event of a stock shortage, we will inform the customer, who may then cancel their purchase. In this case, all amounts paid will be fully refunded.

3: Price
Prices are in euros, all taxes included according to Mauritian tax legislation. Shipping costs are extra and depend on the weight and delivery location of the Customer's order. Local fees and various taxes related to the importation of products into the Customer's country are the responsibility of the Customer. The Customer must pay these taxes either to the carrier or to the tax authorities of his country.
All orders, regardless of their origin, are payable in euros.
Vanill'Art reserves the right to modify prices at any time. The price listed on the sales page on the day of the order is the only price applicable to the customer.

4: Availability
Products are offered while stocks last. In the event of product unavailability, Vanill'Art undertakes to inform its customer by telephone or email as quickly as possible. Vanill'Art undertakes to offer another equivalent product or to reimburse its customer in the event of unavailability of the ordered product.

5: Payment terms
Payment is due upon ordering.
For payments by bank transfer, the order is only shipped upon receipt of the transfer in question.
Failure to pay will result in the suspension or termination of the order.
Vanill'Art is not responsible for the banking site used by the customer to make the transfer, and cannot under any circumstances be held responsible by the Customer for the consequences of improper use of said sites on its part, nor for the inaccessibility of this site if the eventuality should arise.
The Customer's account will be debited immediately.

6: Delivery terms
The products are delivered to the address indicated by the customer at the time of ordering.
The customer must check the condition of the package upon receipt and report any defects or damage to the carrier in the form of handwritten and signed reservations. The customer must inform Vanill'Art of this on the same day. In the event of a delivery error, all products must be returned in their original packaging after agreement from Vanill'Art. The product will then be returned or exchanged, and the shipping costs will be refunded, except in the case where it turns out that the returned product does not correspond to the declaration made by the customer.
The Products are delivered to your home by post.
The delivery times indicated are the most common and are for informational purposes only. Vanill'Art guarantees delivery to Mauritius within 3 to 5 days, excluding weekends and public holidays, except in cases of force majeure. Vanill'Art cannot be held responsible for carriers' uncertainties.
Delivery times for shipments abroad (metropolitan France) are 12 to 14 working days if the customer chooses the Mauritian Post option and 3 to 7 working days if the customer chooses the DHL option.
Complaints regarding delivery issues are accepted within 48 hours of delivery of the packages.
Disputes related to carrier deliveries will not be reimbursed if the carrier is able to provide proof of delivery.

7: Command
The Customer acknowledges having verified the suitability of the Product for his needs and having received from Vanill'Art all the information he needs to subscribe to this commitment with full knowledge of the facts.
The Customer declares that he/she has the legal capacity or holds parental authorization allowing him/her to place an order on the Site.

8: Experience – Visit to the vanilla plantation
Customers can pre-book an experience with Vanill'Art, i.e., a visit to the vanilla plantation, online. Payments by bank transfer are accepted.
The pre-reservation is converted into a reservation by Vanill'Art according to its own reservation calendar. Once Vanill'Art accepts the reservation, the customer receives an email confirming it. Vanill'Art reserves the right to cancel any pre-reservation on its own initiative so as not to penalize its vanilla farming business.
The customer has the option to modify or cancel their reservation online up to 5 days before the chosen visit date.
In case of cancellation less than 5 days before the chosen visit date, the latter will be considered due.
In case of delay, we wait a maximum of 15 minutes before considering it as a No show and the visit due.
No tour will be refunded unless the outing is canceled (by Vanill'Art) due to bad weather.
The tour will continue in the event of cloudy weather and occasional rain, unless deemed risky for the group. Vanill'Art will be the sole judge of cancellation or termination of the activity.

9: Responsibility
The Product complies with current Mauritian legislation and the standards applicable in Mauritius. Vanill'Art cannot be held liable in the event of non-compliance with the legislation of the country where the Product is delivered. It is the Customer's responsibility to check with the local authorities of their country of residence the possibilities of using the Product they plan to order on the Site.
Vanill'Art cannot be held responsible for non-delivery of the Product if the Customer's address provided on the Vanillart.store payment site or by any other means is outdated or invalid, or if the Customer's mailbox is inaccessible or non-functional.

10: Applicable law – dispute.
The sale between Vanill'Art and its client is subject to Mauritian law. In the event of a dispute, only the Court of the district on which Vanill'Art depends shall have jurisdiction, even in the event of multiple defendants or third-party claims.
